GUEST NOMINATIONS

Our Website contains a form that permits website visitors to nominate guests, including themselves, to appear on the Podcast. To complete the guest nomination process, visitors must provide their own names and email addresses. Additionally, a visitor who nominates a guest (the “Nominator”) must provide the name of the nominated guest and personal details that the Nominator believes make that guest suitable for the Podcast, including for self-nominated guests. In order to submit a nomination through the webform or by any other means, the Nominator must represent that the nominated guest has knowledge of the nomination and has affirmatively consented to the disclosure of their name and the personal details that the Nominator chooses to provide. You acknowledge and agree that Company shall not be liable for a Nominator’s unauthorized disclosure of the Personal Information of a nominated guest, and that Nominator shall indemnify Company for any claims arising from Nominator’s unauthorized submission of the nominated guest’s Personal Information.

HOW WE PROTECT YOUR PERSONAL INFORMATION 

Personal Information is maintained on our servers or those of our service providers, and is accessible by authorized employees, representatives, and agents as necessary for the purposes described in this privacy policy. We use reasonable and appropriate physical, technical, and organizational safeguards designed to promote the security of our systems and protect the confidentiality, integrity, availability, and resilience of Personal Information. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and Company, or information stored on the Website, or on our servers, will be free from unauthorized access by third parties such as hackers, and your use of the Services demonstrates your assumption of this risk. DATA RETENTION

We will retain your personal information for as long as you remain subscribed to the Podcast, or as needed to perform our contractual obligations, provide the Services through the Website, comply with legal obligations and preserve legal rights, resolve disputes, or enforce our agreements. We determine retention periods by considering the categories of information collected and the purpose for such collection and evaluate when to delete personal information that is no longer required or is outdated. We may update, correct, or delete inaccurate or incomplete information at our sole discretion. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregated data previously collected.

We are not responsible for the privacy and security practices of other websites, applications, services, or social media platforms, or the information they may collect (which may include IP addresses or device identifiers). Links to any other websites, applications, services, social media platforms, or content do not constitute or imply an endorsement or recommendation by us of the linked website, application, services, social media platform, and/or content.

Our Podcast may be accessed or downloaded through third-party podcast hosting or publishing platforms (“Podcast Providers”). Personal Information associated with your interactions with the Podcast may be processed in accordance with the privacy policies of Podcast Providers through which you listen to, subscribe, or download the Podcast. We are not responsible for the privacy and security practices of Podcast Providers, and you should refer to such Podcast Providers’ privacy policies on their sites to determine their respective privacy practices. When clicking a link on our Website to listen directly to an episode of the Podcast, you will be redirected to the website of our podcast hosting service, Omny Studio, whose listener privacy policy may be viewed here. You may also listen to or download the Podcast on Spotify, iHeart Podcasts, Apple Podcasts, and other platforms. As above, please refer to such third parties’ privacy policies on their websites to review their privacy practices.

You should be aware that any Personal Information that you voluntarily include and transmit online in a publicly accessible blog, forum, social network, or otherwise may be viewed and used by others. By using such features, you assume the risk that the Personal Information you provide may be viewed and used by third parties.

CROSS-BORDER DATA TRANSFERS

If you submit Personal Information to us, such information may be processed in a jurisdiction where privacy laws may be less stringent than those in your country of residence. By submitting your Personal Information to us, you agree to the transfer, storage, and processing of such information in foreign jurisdictions including, but not limited to, the United States. Your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States. 

CHILDREN’S PRIVACY

Our Website is intended for users ages 18 and over. We do not knowingly collect Personal Information from persons under 18 years old. In the event we become aware that Personal Information (or other information protected under applicable law) from a person under 18 (or such other age as may be restricted under applicable law) has been collected, we will use all reasonable efforts to delete such information from our database.   • Email Messages

If you receive a marketing/promotional email from us, you may unsubscribe from any future such emails by clicking the “unsubscribe” link in a marketing/promotional email that you receive from us, or by sending an unsubscribe request by email to shepivots@etsstrategy.com. We will process your request within a reasonable time after receipt. 

  • Cookies and Tracking Technologies

As described above in Personal Information We Collect Automatically, we may use cookies and other tracking technologies for the purposes stated in that section.

CALIFORNIA “SHINE THE LIGHT”
